WAIVER, RULES & POLICIES OF THE IRON PLATE GYM (PRIVATE GYM):
At THE IRON PLATE, WE ARE A PRIVATE GYM, we have adopted policies, procedures, rules and regulations ("policies") designed to provide for the safe, enjoyable and healthy use of our premises and events by you-our members and guests.
These policies apply to your conduct on Iron Plate's premises, which include, but is not limited to, facilities, spaces and all outdoor areas, including its parking lots, sidewalks, or any use of The Iron Plate's online, mobile or interactive offerings or websites. These policies also apply to your conduct during our programs, services, products, training, field trips, events, or other Iron Plate-sponsored activities on or off the premises ("events").
The health and safety of our members and guests is our highest priority. While our policies are designed to help protect you, Iron Plate cannot remove all risk or otherwise guarantee or promise that you will not sustain any injuries or damages from viruses, communicable, contagious, or other infectious diseases, or other health hazards associated with your use of Iron Plate's premises, facilities, equipment, services, activities, events or products ("Use of Iron Plate's Premises and Services"), including, without limitation, exposure, transmission, infection, illness, sickness, disease or death with respect COVID-19, its variants and subvariants, and the virus that causes it, SARS-CoV-2. Because our clubs provide opportunities for vigorous higher-intensity exercise, you may experience or encounter more significant respiration than in other locations. To help protect our community, we encourage you to refrain from the Use of Iron Plate's Premises and Services if you have symptoms of COVID-19, or any of its variants or subvariants and/or any infectious disease, maintain social/physical distance at all times from others with whom you do not share regular contact, and subject to individual health conditions use a barrier mask within our premises.
These policies supplement those posted or otherwise provided in our gym, on our web or mobile sites or at our events. We may adopt policies applicable to a single center or event. In some instances, the state law, order or guideline may establish different requirements applicable to certain centers or events that may otherwise not be described herein. To the extent of a conflict with other policies, the more restrictive policy applies.
If you violate any of these policies, your membership, center access, or event participation may be suspended or terminated. Our decision on all questions regarding the construction or interpretation of these policies is final.
We may change these policies at any time without notice, in our sole discretion. As a member or guest of The Iron Plate, you are responsible and expected to review and comply with these policies at all times.
GENERAL POLICIES:
RULES AND REGULATIONS: You acknowledge the existence of and the need for rules and regulations governing your membership and use of The Iron Plate equipment and facilities and participation in services (the "Rules and Regulations"). The Iron Plate reserves the right to modify, amend or supplement the Rules and Regulations from time to time in its sole discretion, and you agree to comply with the Rules and Regulations in effect and as they may hereafter be modified, amended or supplemented. The Iron Plate may cancel your membership (and any services or products purchased from The Iron Plate) at any time for breach of the Rules and Regulations or generally undesirable behavior, as determined by The Iron Plate in its sole discretion, and you will not be entitled to a refund of any portion of enrollment fees or dues paid to the date of cancellation.
Accessibility Policy. The Iron Plate is committed to ensuring the accessibility of our centers and websites for people with disabilities. We aim to create an experience that is accessible to everyone.
Proper Conduct. We strive to uphold a family-oriented environment. As such, we expect proper and respectful conduct on our premises at all times. We do not permit disrespectful conduct toward our members, guests, staff, vendors, or property, including but not limited to: vulgar, profane, indecent, offensive, violent, hostile, aggressive, threatening, harassing, stalking, fraudulent, or other inappropriate conduct or communications.
Illness, Sickness, Disease, or Infection. If you have any symptoms associated with, or you may have been exposed to a person with, a communicable, contagious or otherwise transferrable or transmissible illness, sickness, disease, or infection, including, but not limited to, COVID-19, it's variants and subvariants, or the virus that causes it, SARS-CoV-2, or you otherwise pose a health risk to members, guests, team members or the public at large on account of such status, you may not engage in and will immediately remove yourself from the Use of The Iron Plate Gym Premises and Services. All exposed lesions or rashes must be covered. Furthermore, members and guests must follow all signs, applicable rules or laws, whether posted or not.
Cleaning. The Iron Plate employs various cleaning, hygiene, disinfecting, and sanitation protocols related to the operation and maintenance of the premises. The Iron Plate protocols are designed to be consistent with CDC guidelines, but there are still dangers, hazards and risks of injury or damage, including, but not limited to, illness, sickness, disease and infection, when engaging in the Use of The Iron Plate Premises and Services. These risks include, but are not limited to, contact with or exposure to other members, team members, guests, or vendors who are ill, sick, or have disease, infection, impairment, or other injury, as well as contact with or exposure to communicable or contagious diseases; infection or infectious agents; pathogens such as viruses, bacteria, fungi, mold or other microorganisms; and other health dangers, hazards and risks that can cause illness, sickness, disease, infection, impairment or other injuries.
General Hygiene. We expect you to uphold general basic hygiene. Please wash your hands regularly with soap and water for at least 20 seconds or use our hand sanitizer (or your own, if it contains at least 60% alcohol), especially after use of equipment or fixtures. Avoid touching your eyes, nose and mouth with unwashed hands. Also, please refrain from excessive use of scented oils, lotions, colognes, perfumes or other fragrances out of respect for other members with whom may have fragrance or chemical sensitivities or allergies. It is also expected that you refrain from or avoid smelling of smoke and body odor of any kind or other fragrant substances upon entry or use of the premises. We are in a shared space please be kind of others and wear deodorant. The Iron Plate Gym has the right to terminate your membership for not adhering to the "General Hygiene" rules.
Weapons. You may not possess, display, use or distribute weapons of any kind nor use any object designed for other purposes as a weapon to threaten, harass or harm a person on The Iron Plate Gym premises or off The Iron Plate Gym premises for any sponsored, endorsed or operated programs, activities, classes, sessions, seminars, workshops, assessments, events, services, amenities, or benefits, for any reason except as otherwise expressly allowed by law.
Proper Attire. You must wear proper attire at all times, including shirts and shoes, unless noted in a specific area or as appropriate for a specific activity or class.
Membership ACCESS KEY and Check-In. As a member, you may not enter the center without checking-in using your own access key. Any member who does not abide by this rule will either be charged a tailgate fee of $50 or membership will be terminated at the discretion of the Iron Plate Gym.
Lockers. Lockers are available for members and guests to store their belongings in while utilizing the Iron Plate facilities, programs, events and services. You are responsible for keeping your locker key with you at all times. Do not leave your locker key unattended at any time. If your locker has a combination lock, you are responsible for remembering your locker number and lock combination. Be sure that your locker is secured before you leave it. You may use our lockers only while you are on the premises; you may not leave any personal belongings in a locker overnight. All items left in lockers overnight will be removed. Do not bring or store any valuables on the premises, including, but not limited to, watches, jewelry or cash. The Iron Plate Gym is not liable or responsible for any lost, stolen or damaged property left in locker(s). The Iron Plate Gym reserves the right to search all of our lockers without notice and in our sole discretion.
Equipment. You may not modify anyThe Iron Plate Gym equipment from its intended use. You may not bring in personal equipment, mechanical or otherwise, unless first approved by The Iron Plate Gym, at our sole discretion, any such approval may be revoked at any time for any reason.
Parking Lot. Do not leave valuables in your vehicle. Be sure your vehicle is locked. We are not liable or responsible for any lost, stolen or damaged property from vehicles nor damage to or theft of the vehicle itself.
Injuries. If you are injured while on The Iron Plate Gym premises, please seek immediate assistance and call 911. The Iron Plate Gym is not responsible for, nor will we consider reimbursement of member medical costs, including, but not limited to charges a member may incur for emergency response services, ambulance, etc., in the case of a member medical event or emergency that occurs at The Iron Plate Gym premises, facilities, or events including those off its premises.

We do not permit disrespectful conduct toward our members, guests, employees ("Team Members"), vendors, or property, including but not limited to: vulgar, profane, indecent, offensive, violent, hostile, aggressive, threatening, harassing, stalking, fraudulent, or other inappropriate conduct or communications.
Damage to GYM or Equipment. You may not damage the gym in any way, including but not limited to any damage to, or theft of, exercise equipment, towels, supplies, or other gym property. If you, or a guest, youth member, or junior member on your membership damages the center, you are liable and must pay for the damage caused and your membership may be terminated.
LIABILITY FOR PERSONAL PROPERTY: The Iron Plate shall not be liable to you, your children, your guests or invitees for any personal property that is damaged, lost or stolen while on or around The Iron Plate Gym's premises or at an off-site services location including but not limited to, a vehicle or its contents or property left in a locker. You shall be liable to The Iron Plate for any damage to The Iron Plate facilities and any toys, equipment, furniture or fixture located thereon caused by you, your children, or your guests or invitees.
HEALTH REPRESENTATIONS AND AGREEMENTS: You represent and warrant to The Iron Plate that you are in good physical condition and have no medical reason or impairment that could prevent you from your intended use of The Iron Plate facilities, equipment, programs or services. You acknowledge that The Iron Plate has not given you any medical advice before you joined The Iron Plate and cannot give you any such advice after you join The Iron Plate, whether related to your physical condition and ability to use the facilities, equipment, programs and services of The Iron Plate Gym or otherwise. You agree to discuss any health or medical concerns with your physician or other health professional prior to using The Iron Plate facilities, equipment, programs, and services.
CONSENTS, WAIVERS OF LIABILITY, INDEMNIFICATION:
WAIVER OF LIABILITY: YOU ACKNOWLEDGE THAT THE USE OF THE IRON PLATE FACILITIES (AND ANY ACTIVITIES CONDUCTED OUTSIDE THE FOUR WALLS OF THE GYM, INCLUDING BUT NOT LIMITED TO PARKING LOTS AND OTHER AREAS NEAR THE GYM, OR AT OFF-SITE BOOTCAMPS), EQUIPMENT, MERCHANDISE, SERVICES AND PROGRAMS (INCLUDING DIGITAL FITNESS SERVICES, PERSONAL AND GROUP TRAINING, BOOTCAMPS, AND FITNESS ASSESSMENT SERVICES) INVOLVES AN INHERENT RISK OF PERSONAL INJURY TO YOU AND YOUR GUESTS AND INVITEES. YOU VOLUNTARILY AGREE TO ASSUME ALL RISKS OF PERSONAL INJURY TO YOU, YOUR SPOUSE, CHILDREN, UNBORN CHILDREN, OTHER FAMILY MEMBERS, GUESTS OR INVITEES AND WAIVE ANY AND ALL CLAIMS OR ACTIONS THAT YOU MAY HAVE AGAINST THE IRON PLATE, ANY OF ITS PARENTS, SUBSIDIARIES OR OTHER AFFILIATES AND ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS FOR ANY SUCH PERSONAL INJURY (AND NO SUCH PERSON OR ENTITY SHALL BE LIABLE TO YOU, YOUR SPOUSE, CHILDREN, UNBORN CHILDREN, OTHER FAMILY MEMBERS, GUESTS OR INVITEES FOR ANY SUCH PERSONAL INJURY), INCLUDING, WITHOUT LIMITATION: (I) INJURIES ARISING FROM USE OF ANY EXERCISE EQUIPMENT, MACHINES, TANNING BOOTHS, AND GROUP EXERCISE (INCLUDING BOOTCAMP), DIGITAL, OR PERSONAL TRAINING SERVICES; (II) INJURIES ARISING FROM PARTICIPATION IN SUPERVISED OR UNSUPERVISED ACTIVITIES AND PROGRAMS IN EXERCISE ROOMS, RUNNING TRACKS, PARKING LOTS, HOT TUBS, COURTS, PARKS, PARKING GARAGES OR OTHER AREAS INSIDE OR OUTSIDE OF ANY THE IRON PLATE, (III) INJURIES ARISING FROM THE IRON PLATE NEGLIGENCE, WHETHER DIRECT OR INDIRECT; (IV) INJURIES, DISEASE, INFECTION OR MEDICAL DISORDERS RESULTING FROM EXERCISING INSIDE OR OUTSIDE OF ANY PART OF THE IRON PLATE, INCLUDING HEART ATTACKS, STROKES, HEAT STRESS, SPRAINS, BROKEN BONES AND TORN OR DAMAGED MUSCLES, LIGAMENTS OR TENDONS; (V) ACCIDENTAL INJURIES WITHIN OR OUTSIDE OF ANY THE IRON PLATE FACILITIES, INCLUDING LOCKER ROOMS, STEAM ROOM, WHIRLPOOLS, HOT TUBS, SPAS, SAUNAS, SHOWERS, DRESSING ROOMS AND OFF-SITE BOOTCAMP LOCATIONS; AND (VI) INJURIES ARISING FROM DISCLOSURE, TRANSMISSION, STORAGE, OR USE OF FITNESS ASSESSMENT SERVICES INFORMATION AND DATA DERIVED THEREFROM. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, YOU ALSO WAIVE ALL CLAIMS AGAINST THE IRON PLATE, ANY OF ITS PARENTS, SUBSIDIARIES OR OTHER AFFILIATES AND ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS FOR ANY CLAIMS YOU MAY HAVE UNDER ANY OF THE STATE'S CONSUMER PROTECTION STATUTES. THE PROVISIONS OF THIS PARAGRAPH SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT AND YOUR MEMBERSHIP.
ASSUMPTION OF RISK AND INDEMNIFICATION (EQUIPMENT AND RETAIL PRODUCTS): You acknowledge that The Iron Plate Gym (i) does not manufacture fitness or other equipment at its facilities and (ii) does not manufacture any vitamins, food products, sports drinks, nutritional supplements or other products sold at its facilities. Accordingly, neither The Iron Plate nor any of its parents, subsidiaries, or affiliates nor any of their respective officers, directors, employees, agents, successors or assigns ("Indemnified Parties") shall be held liable for any such defective equipment or products. You shall indemnify the Indemnified Parties and save and hold each of them harmless against and pay on behalf of or reimburse any such Indemnified Parties as and when incurred for any losses which such Indemnified Parties may suffer, sustain or become subject to, as a result of, in connection with, relating or incidental to or by virtue of any claim that is the subject of the waiver set forth above. The provisions of this paragraph shall survive termination of your membership and this Agreement.
*The Iron Plate, a private gym, may cancel your membership (and any services or products purchased from The Iron Plate) at any time for breach of the Rules, Regulations & Policies or generally undesirable behavior or hygiene, as determined by The Iron Plate in its sole discretion, and you will not be entitled to a refund of any portion of enrollment fees or dues paid to the date of cancellation.
